Terms of Service

1. Acceptance

By creating an account or using AARSSystem at https://aarssystem.com(the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Fresh Roof USA ("we", "us").

2. Who can use the Service

• You must be 18 or older and a representative of a roofing or field-services company.
• You are responsible for all activity under your account and must keep your password confidential.
• Company administrators may create accounts for their employees; those employees are bound by these Terms as individual users.

3. Your content and data

• You retain ownership of all customer records, photos, notes, and data you upload ("Your Data").
• You grant us a limited license to host, transmit, display, and process Your Data solely to provide the Service to you.
• You are responsible for ensuring you have the right and consent to store your customers' data in AARSSystem, including compliance with applicable privacy laws (GDPR, CCPA, TCPA, CAN-SPAM, etc.).
• You are responsible for honoring unsubscribe requests and not sending unsolicited commercial email.

4. Acceptable use

You may not:

• Send spam, unsolicited bulk email, or commercial email in violation of CAN-SPAM / CASL.
• Use the Service to harass, defame, or impersonate any person.
• Scrape, reverse-engineer, or interfere with the Service or its infrastructure.
• Use the Service for unlawful purposes or to transmit malware.
• Abuse the Storm Sweep feature by sending emails to homeowners with no reasonable connection to your service area.

We may suspend or terminate accounts that violate these rules.

5. Google account connection

When you connect your Gmail or Google Calendar, you authorize AARSSystem to send email and create calendar events on your behalf via Google's APIs. Connecting your Google account is entirely optional. You can disconnect at any time from the Settings page or at myaccount.google.com/permissions.

6. Fees and billing

Certain features may be offered under paid subscription plans. Pricing is displayed in-app before purchase. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice.

7. Third-party services

The Service integrates with Mapbox, Google APIs, RainViewer, NOAA, Iowa Environmental Mesonet, and Anthropic. These third parties have their own terms and privacy policies, and we are not responsible for their services.

8. Intellectual property

All rights in the Service, including its code, designs, logos, and content we create, are owned by Fresh Roof USA or its licensors. You may not copy, modify, or redistribute the Service except as permitted by law.

9. Warranty disclaimer

The Service is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Weather and storm data are provided by third parties and we do not guarantee their accuracy.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the fees you paid us in the 12 months before the claim, or (b) USD $100. We are not liable for indirect, incidental, consequential, special, or punitive damages.

11. Indemnification

You agree to indemnify and hold us harmless from any claims arising out of your violation of these Terms, your misuse of the Service, your violation of law, or your infringement of any third party's rights — including claims arising from emails you send via Storm Sweep.

12. Termination

You may cancel your account at any time from Settings → Profile. We may suspend or terminate your access if you violate these Terms or if your account is inactive for 12+ months. Upon termination, your data will be deleted per our Privacy Policy.

13. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Dallas County, Texas.

14. Changes

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use after changes constitutes acceptance.
